THE GREY HILL — TERMS, RETURNS & CANCELLATIONS (UK)

1) About Us

2) What We Provide

We sell digital content (ebooks, audiobooks and music downloads) and access to digital events (e.g., live Q&A sessions and music livestreams hosted online). Digital content is sold on behalf of the publisher, artist or rights-holder — see Section 12 (Marketplace & Retail Agent Terms).

3) Orders & Contract Formation

3.1 Your order is accepted when we email your Order Confirmation. The checkout button states "Order with obligation to pay".

3.2 Before purchase, we provide key information (price incl. taxes, any delivery or access details, cancellation rights), and we confirm it by email (durable medium).

4) Prices & Payment

Prices include applicable taxes. We do not use pre-ticked boxes or add-ons without your consent.

5) Returns & Cancellations (Your UK Rights)

5.1 Digital Content (ebooks, audiobooks & music downloads) • You have a 14-day right to cancel unless you choose immediate access. By completing your purchase, you agree your digital content will be available immediately and you waive your 14-day cancellation right for digital downloads. • Digital content (ebooks, audiobooks and music downloads) is sold on behalf of the publisher, artist or rights-holder. The Grey Hill acts as a retail agent (see Section 12). Your consumer rights under the Consumer Rights Act 2015 are unaffected.

5.2 Digital Events (live online events including music livestreams) • If your purchase includes access to a live online event at a specific date/time, the usual 14-day cancellation right does not apply (UK "leisure services" exemption). • We do not offer refunds for missed or partially attended events. If we cancel the event or fail to provide access, we will refund the event portion or provide a suitable alternative. • Access to the event will be provided online and may remain available for up to 48 hours. Once access begins, you cannot cancel under the 14-day cooling-off period.

5.3 Bundles (Livestream Ticket + Music Download) • Where you purchase a bundle containing a livestream ticket and a music download, the livestream portion is subject to Section 5.2 and the download portion is subject to Section 5.1. • If the livestream is cancelled by us, we will refund the full bundle price or offer a suitable alternative.

5.4 Subscriptions (e.g., ebook rentals) • You have 14 days from sign-up to cancel unless you ask us to start the service immediately. If you cancel after service starts, we may charge a proportionate amount for use up to cancellation. • After 14 days, our standard subscription cancellation terms apply (no refunds for the current billing period).

5.5 Faulty Digital Content or Event Access If your ebook, audiobook, music download or event link is faulty (for example, the file won't download/play or the access link does not work), we will repair, replace or refund in line with the Consumer Rights Act 2015.

5.6 How to Cancel Email info@thegreyhill.com with your order details. We will confirm receipt and process applicable refunds within statutory timelines.

6) Delivery & Access

Events may be delivered via YouTube or other online platforms. Digital content (ebooks, audiobooks and music downloads) is delivered via our app and/or online store using third-party technology and hosting services. You are responsible for a compatible device, internet connection and, where required, a platform account. We do not control third-party platform or technology provider availability; if a platform experiences outages or technical issues beyond our control, we will make reasonable efforts to provide alternative access (e.g., replay, reschedule, or alternative download). Access to events may remain available for up to 48 hours after the scheduled time. Once access begins, you cannot cancel under the 14-day cooling-off period. The Grey Hill does not own or operate the underlying technology platform used to deliver digital content and is not liable for issues arising from third-party technology failures, provided we make reasonable efforts to resolve access problems.

7) Liability

We do not exclude or limit liability where unlawful to do so (including for death/personal injury caused by negligence, fraud, or your statutory rights). Subject to the foregoing, we are responsible only for loss or damage that is foreseeable and caused by our breach of contract or failure to use reasonable care and skill.

8) Changes to these Terms

We may update these terms for valid business reasons (e.g., changes in law or product/service updates). We will post changes here and, for material changes, notify you by email. If a change materially disadvantages you, you may cancel affected contracts.

9) Governing Law & Jurisdiction

These terms are governed by the laws of Scotland. Disputes are subject to the jurisdiction of the Scottish courts, without affecting mandatory consumer protections where you live.

10) Privacy & Cookies (Summary)

We comply with UK GDPR and PECR. We only set essential cookies unless you consent to analytics/marketing cookies. You can manage choices at any time. See our full Privacy Policy for details (link).

11) Immediate Supply Consent (Checkout Reference)

By completing your purchase you agree that your digital content/event access starts immediately and acknowledge that you lose your 14-day cancellation right once supply begins. This does not affect your statutory rights regarding faulty content or non-provision.

12) Marketplace & Retail Agent Terms (Digital Content)

12.1 The Grey Hill acts as a retail agent and online storefront for the sale of digital content, including ebooks, audiobooks and music downloads. The publisher, producer, artist or rights-holder ("the Seller") remains the legal seller of all digital content sold through our store.

12.2 The Grey Hill does not claim ownership of any recordings, compositions, literary works, or associated intellectual property rights. All copyright, publishing, mechanical reproduction, and performer rights and obligations remain the sole responsibility of the Seller.

12.3 The Grey Hill provides storefront services including: hosting the product listing, processing payment on behalf of the Seller, and delivering the digital file to the customer. The Grey Hill receives a commission on each sale as agreed with the Seller. Delivery of the digital file is performed by The Grey Hill on behalf of the Seller and does not constitute The Grey Hill acting as the publisher or rights-holder.

12.4 By purchasing digital content from our store, you acknowledge that the Seller (not The Grey Hill) is the legal supplier of the digital product. Your statutory rights under the Consumer Rights Act 2015 apply to the Seller. The Grey Hill will assist in resolving any issues with your purchase, including facilitating refunds or replacements where appropriate.

12.5 The Seller warrants to The Grey Hill that they own or control all necessary rights to the content, and that the sale of the digital product does not infringe any third-party rights. The Grey Hill is not liable for any rights infringement by the Seller.

12.6 For the avoidance of doubt, The Grey Hill does not hold and is not required to hold an MCPS mechanical licence, publishing licence, or any other content rights licence in connection with the sale of digital content through its store. All such obligations rest with the Seller.

12.7 This section applies to digital content (ebooks, audiobooks and music downloads) only. Livestream event tickets are sold directly by The Grey Hill and are subject to the standard terms in Sections 3–5 above.
